1. Acceptance of These Terms

By opening an account, purchasing a subscription, or accessing any part of the Gempix2 AI service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any provision, you must not use the Service.

3. What the Service Does

Gempix2 AI provides a user-friendly interface built on top of third-party AI models (including models developed by Volcano Engine/ByteDance) to deliver image editing, video generation, and conversational AI features. Gempix2 AI is an independent service and is not affiliated with, endorsed by, or sponsored by any upstream AI model provider. We do not claim ownership of or partnership with any AI model used in our platform.

4. Accounts and Eligibility

You must be at least thirteen years old, or the age of digital consent in your jurisdiction, to register. You are responsible for everything that happens under your login, including safeguarding your credentials. We may suspend or close accounts that breach these Terms.

5. Plans, Pricing, and Taxes

Current price tiers and generation limits appear on the pricing page and, unless stated otherwise, are listed in United States dollars (USD). Subscriptions renew automatically at the end of each billing period. Applicable taxes are calculated and added at checkout.

5.1 Payment Handling

Payments are processed by Creem, with Stripe or PayPal offered where available. We never store your full card number. By purchasing you authorise our payment processor to charge the chosen method.

6. Refunds and Cancellations

You may cancel within fourteen days of your first payment while unused generation credits remain for a pro-rated refund by emailing support@gempixai.pro. After day fourteen, fees are non-refundable. You can stop future renewals at any time, and your plan remains active until the end of the paid term. We may deny or revoke a refund in cases of charge-back abuse, fraud, or material breach.

7. Intellectual Property

7.1 Our Materials

All site code, models, and content (aside from User Content) belong to Gempix2 AI or its licensors and are protected by law.

7.2 Your Materials

You retain rights in everything you upload and in all AI-generated outputs, except that you grant us a non-exclusive licence to store, display, and process those materials solely to operate and improve the Service. You are responsible for ensuring that any output you publish or commercialise complies with applicable law and third-party intellectual-property rights.

8. Acceptable Use Policy & Content Standards

8.1 Prohibited Content

You agree not to upload, request, generate, or share content that is:

• Sexually explicit, nude, semi-nude, or sexually suggestive (including undressing, suggestive poses, or erotic content)
• Involving minors in any sexual or inappropriate context
• Unlawful, defamatory, hateful, or harassing
• Violent, gory, or inciting violence
• Infringing on another party's intellectual-property rights
• Intended to create deceptive deepfakes or impersonations

8.2 Content Moderation

Gempix2 AI employs content moderation mechanisms to detect and block prohibited content. Any prompt or input that violates these standards will be rejected, and the corresponding output will not be generated. We reserve the right to update our moderation policies at any time.

8.3 Enforcement

Repeated violations of this Acceptable Use Policy will result in warnings, account suspension, or permanent termination without refund, depending on the severity of the breach.

9. Generated Content Disclaimer

AI outputs are produced algorithmically and may contain inaccuracies or unexpected artefacts. Verify suitability before relying on them commercially. We provide no warranty that any output will meet a specific artistic, technical, or fitness standard.

10. Third-Party Services

The Service integrates or references third-party tools, such as Vercel, Creem, and Google Analytics. Your use of those services is governed by their respective terms.

11. Indemnity

You agree to indemnify and hold harmless Gempix2 AI, its officers, and employees against any claim arising from your use of the Service or your breach of these Terms.

12. Limitation of Liability

To the fullest extent permitted by law, Gempix2 AI will not be liable for any indirect, incidental, special, or consequential loss, or for loss of profit, data, or goodwill arising from or related to the Service, even if advised of the possibility. Our aggregate liability is limited to the amount you paid us in the twelve months preceding the event.

13. Termination

You may cancel your subscription or close your account at any time by emailing support@gempixai.pro. Your plan remains active until the end of the current paid term. We may suspend or terminate the Service or your account with reasonable notice, or immediately in cases of fraud or material breach.

14. Changes to the Service or These Terms

We may update the Service or these Terms at any time. For material changes, registered users will receive at least seven days' email notice. Continued use after the effective date signifies acceptance.

15. Governing Law and Disputes

These Terms are governed by Singapore law. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Singapore.
